Beginning on October 2, 2020 the fees for forms to be filed before USCIS changed. 

However, on Sept. 29, 2020, the U.S. District Court for the Northern District of California in Immigration Legal Resource Center et al., v. Wolf, et al., 20-cv-05883-JWS, temporarily suspended the application of the USCIS Fee Schedule. 

While the rule is preliminarily enjoined, USCIS will continue to:

  • Accept USCIS forms with the current editions and current fees; and
  • Use the regulations and guidance currently in place to adjudicate applications and petitions. This includes accepting and adjudicating fee waiver requests as provided under Adjudicator’s Field Manual (AFM). 

We encourage our clients that are eligible for immigration benefits to file their cases before a court decision could reverse this suspension, making more expensive their cases. 

For instance, a family petition of an immediate relative which requires filing of form I-130 Petition for alien relative and Form I-485, Application to Register Permanent Residence or Adjust Status, which usually had a total cost of 1,760 including ancillary forms I-765 (Employment Authorization Document), I- 131 (application to travel document) and biometrics will increase to $2,830.
